The thesis face up the issue of informed consent to the medical act on the basis of general profiles, the notion of consent itself and drawing on costitutional profiles and supranational sources, and then tackling the disclipline of the full consent of requirements and content. Proceeding with the speech, the recipients of the information obligation and the subjects entitled to give consent are identified, with particular attention to minors, interdicted, disabled, and beneficiaries of the support administration. Carrying on, we focus on the freedom of therapeutic self-determination, focusing attention on the patient's right to self determination and on the obligation tu cure himself, pssibly being able to refuse the therapy. Last but not least, the last chapter examines the issue of the pathological ohase of the relationship between doctor and patient by analysing the profiles of responsability, the violtion of the rules and informed consent and compnsable damages.
La tesi affronta il tema del consenso informato all'atto medico partendo dai profili generali, la nozione di consenso stesso e attingendo ai profili costituzionali e le fonti sovranazionali per poi affrontare, in un secondo momento, la disciplina del consenso completa di requisiti e contenuto. Procedendo nel discorso, si individuano i destinatari dell'obbligo informativo e i soggetti legittimati a prestarvi il consenso con particolare attenzione ai minori di età, ai soggetti interdetti, inabilitati ed ai beneficiari dell'amministrazione di sostegno. Proseguendo ci si sofferma sulla libertà di autodeterminazione terapeutica, concentrando l'attenzione sul diritto del paziente ad autodeterminarsi e sull'obbligo di curarsi potendo eventualmente rifiutare la terapia. Infine, l'ultimo capitolo approfondisce il tema della fase patologica del rapporto medico-paziente analizzando i profili di responsabilità, la violazione delle regole in materia di consenso informato e danni risarcibili.
