La circolazione dell'opera ad esemplare unico ed il sequestro

This studyaims to recover works of art seized by verifying the eligibility of an exposure during the long days of custody. Occurred if the author has the power or not to ban this form of exploitation of the work, we analyze the custodial regime seized in criminal and civil proceedings. The goal is to identify what are the powers of the judicial custody and whether there is therefore the possibility of making use of the property seized that goes beyond mere preservation.

Questa tesi è finalizzata a recuperare opere d'arte sequestrate verificando l'ammissibilità di un'esposizione durante i lunghi tempi di custodia. Verificando quindi se l'autore abbia o meno il potere di vietare questa forma di sfruttamento dell'opera, si analizza il regime di custodia del bene sequestrato sia nel processo penale che civile. L'obiettivo è quello di verificare che l'autorità giudiziaria abbia il potere di disporre dell'opera facendone un uso che vada oltre la semplice conservazione.
