This thesis aims to analyse the current ambiguous situation in the region of Quebec (Canada) regarding the exposition of religious symbols, based on first-hand experience and based on the collection of witnesses and material. After a brief introduction of the issue, the discussion begins with a historical and legal explanation of the principle of laicity and the religious freedom. In the following chapters we will deal with the two concepts mentioned before, first from the perspective of the Italian constitutional system and then from the point of view of the Canadian model, with the help of sentences to make sure to understand the principles on a concretely. The fourth chapter focuses on Loi 21, a law in pending approval that has inspired all my research. It aims to establish a neutral environment in the public professional sector in the Canadian region of Québec. We will carefully analyse the draft legislation, we will present the current debate going on in the Canadian courts, and finally we will introduce the risks and the socioeconomic consequences that the approval of this law can lead to. The last chapter illustrates one of the most debated religious symbols of all time, which is the Islamic headscarf. To make our work more even more concrete, we’ll report direct evidence, in this case we will bring up the stories of female Muslims living in Canada touched personally by the issue. Finally, we will conclude by comparing the two models taken into analysis, the Italian one and the Canadian one, and we will try to understand which of the two might fit in the type of society we are currently living in and the most respectful one towards the vision and the mentality that characterizes our lives nowadays.
Questo lavoro ha l’obiettivo di analizzare la situazione ambigua e attuale della regione del Québec (Canada) sull’esposizione dei simboli religiosi, basata sull’ mia esperienza vissuta in prima persona e la raccolta di testimonianze e materiale fatta sul posto. Dopo una breve introduzione della problematica al centro della nostra ricerca, la trattazione inizia prima di tutto con una spiegazione, prima storica e poi giuridica, del principio di laicità e della libertà di religione. È nei capitoli successivi che tratteremo di questi due concetti inserendoli nel sistema costituzionale italiano e poi nel modello canadese, con l’aiuto di sentenze che ci permetteranno di capire nella pratica i principi presentati. Il quarto capitolo si focalizza sulla Loi 21, legge in corso di approvazione che ha ispirato tutta la ricerca e che ha lo scopo di stabilire un ambiente laico nel settore pubblico lavorativo della regione canadese prese in esame. Analizzeremo con accuratezza il progetto legislativo, presenteremo il dibattito ancora in corso nelle corti canadesi e infine i rischi e le conseguenze socioeconomiche che questa legge potrebbe portare. L’ultimo capitolo illustra l’esempio di uno dei simboli religiosi più discussi, ovvero il velo islamico. Per rendere il nostro lavoro ancora più concreto riporteremo le testimonianze raccolte in prima persona dalle musulmane residenti in Canada, toccate in maniera personale dalla questione. Per finire concluderemo confrontando prima i due modelli presi in analisi, ovvero quello italiano e quello canadese, cercando di capire quale dei due potrebbe essere il più adatto al tipo di società e il più rispettoso nei confronti della visione e della mentalità che caratterizza le nostre vite attualmente.
