Il problema delle dispute territoriali nelle relazioni internazionali tra Giappone e Russia.

This study examined the process of emergence and development of the territorial dispute between Japan and the Russian Federation in the context of the evolution of bilateral Japanese-Russian relations: from beginning of the first contacts to the establishment of official ties up to the present time. At the current stage of international relations, the "Kuril problem" is of particular importance for both sides of the territorial conflict. In particular, the geopolitical changes observed at this stage in certain regions and in world politics as a whole may have an impact on the current position of states in this territorial dispute. Hence, the key purpose of this study is to determine the impact of the territorial dispute over the ownership of the four islands of the Northern Territories or the Southern Kuril Islands on the dynamics of the development of relations between Japan and Russia, as well as on the political situation in the Asia-Pacific region as a whole. An analysis of the historical retrospective of Japanese-Russian relations within the framework of local and global historical events revealed internal and external factors that influenced to the dynamics of the development of the "Kuril problem", as well as other parties interested in the dispute, besides Japan and Russia. Used to the content analysis of the content of bilateral and multilateral international treaties related to this issue, it is possible to: (a) examine changes in the legal status of the disputed territories throughout history; (b) reveal the role of the islands in the development of relations between Japan and Russia in the context of international law; and (c) determine nuances and features of the wording of international documents, concerning the fate of the Northern Territories or the Southern Kuriles. Through comparative analysis, it was possible: firstly, to compare the positions of the main parties to the territorial dispute; secondly, to identify the strengths and weaknesses of the legal and historical grounds for Japan's territorial claims and the arguments of the Russian Federation in defending its "rightness"; thirdly, to study the "nature" of the national interests of Japan and Russia in these islands and the reasons why the sides cannot make concessions to each other.

Questo studio ha esaminato il processo di nascita e sviluppo della disputa territoriale tra il Giappone e la Federazione Russa nel contesto dell’evoluzione delle relazioni bilaterali tra i due paesi: dai primi contatti all’instaurazione di legami ufficiali fino ai giorni nostri. Nella fase attuale delle relazioni internazionali, il "problema delle Curili" riveste un'importanza particolare per entrambe le parti del conflitto territoriale. In particolare, i cambiamenti geopolitici osservati in questa fase in alcune regioni e nella politica mondiale nel suo complesso potrebbero influenzare la posizione attuale degli Stati in questa disputa territoriale. Pertanto, l'obiettivo principale di questo studio è determinare l'impatto della disputa sulla sovranità delle quattro isole dei Territori del Nord o delle Curili meridionali sulla dinamica dello sviluppo delle relazioni tra Giappone e Russia, nonché sulla situazione politica nella regione dell’Asia-Pacifico nel suo complesso. L'analisi retrospettiva delle relazioni giapponesi-russe nel contesto degli eventi storici locali e globali ha permesso di individuare i fattori interni ed esterni che hanno influenzato la dinamica dello sviluppo del "problema delle Curili", nonché di identificare altri attori interessati alla disputa oltre al Giappone e alla Russia. Attraverso l’analisi del contenuto di trattati internazionali bilaterali e multilaterali relativi a questa questione, è stato possibile: (a) esaminare i cambiamenti nello status giuridico dei territori contesi nel corso della storia; (b) rivelare il ruolo delle isole nello sviluppo delle relazioni tra Giappone e Russia nel contesto del diritto internazionale; (c) determinare le sfumature e le peculiarità della formulazione dei documenti internazionali riguardanti il destino dei Territori del Nord o delle Curili meridionali. Attraverso l’analisi comparativa è stato possibile, in primo luogo, confrontare le posizioni delle principali parti coinvolte nella disputa territoriale; in secondo luogo, identificare i punti di forza e di debolezza delle basi giuridiche e storiche delle rivendicazioni territoriali del Giappone e delle argomentazioni della Federazione Russa a difesa della propria "legittimità"; in terzo luogo, esaminare la "natura" degli interessi nazionali del Giappone e della Russia su queste isole e le ragioni per cui le parti non riescono a fare concessioni reciproche.
