Comunicazione mafiosa e intercettazioni informatiche: strumenti di contrasto tra tecnica e diritto

The thesis examines the evolution of investigative techniques in the fight against organized crime in light of digital transformations. In particular, it explores the impact of new technologies on mafia communication and the resulting need to adapt interception tools, with specific attention to the growing role of computer and telematic interceptions and the interpretative and practical issues they raise. The study then analyzes the use of spyware (captatore informatico) as an innovative investigative tool, highlighting its legal framework within the Italian legal system. Finally, the last chapter focuses on the EncroChat and SkyECC cases, which are emblematic of the interaction between criminal organizations and new technologies.

La tesi analizza l’evoluzione delle tecniche investigative nel contrasto alla criminalità organizzata alla luce delle trasformazioni digitali. In particolare, si approfondisce l’incidenza delle nuove tecnologie nella comunicazione mafiosa e la conseguente necessità di adeguamento degli strumenti di intercettazione, con attenzione specifica al ruolo crescente delle intercettazioni informatiche e telematiche e ai problemi interpretativi e pratici che queste pongono. Viene poi esaminato il captatore informatico quale strumento d’indagine innovativo, evidenziando il suo inquadramento nell'ordinamento giuridico italiano. Infine, si dedica l'ultimo capitolo ai casi EncroChat e SkyECC, emblematici per comprendere l’interazione tra mafie e nuove tecnologie.
