La libertà religiosa nell'ordinamento italiano, con particolare riferimento alle sentenze della Corte di cassazione.

This work aims to explore the issue of religious freedom in the Italian legal system, with particular reference to the jurisprudence of the Court of Cassation. After an introduction dedicated to the historical background, the first chapter examines the constitutional and supranational regulatory framework in which the right to religious freedom is placed. The second chapter focuses on the impact of this right within family relationships, highlighting emerging issues in cases of separation, child custody, and educational conflicts. The third chapter analyzes the main decisions of the Court of Cassation in cases where religious freedom conflicts with other rights and criminal law, addressing issues related to freedom of expression, discrimination, contempt for religious sentiment, and the limits of religious practices in relation to unlawful conduct. Through an examination of case law, this study aims to highlight how the right to religious freedom is protected and, at the same time, regulated within its limits, in a constant attempt to balance the different but equally relevant constitutional values ​​in a democratic and pluralistic state.

Il presente lavoro intende approfondire il tema della libertà religiosa nel sistema giuridico italiano, con particolare riferimento all'elaborazione giurisprudenziale della Corte di Cassazione. Dopo una premessa dedicata agli antecedenti storici, il primo capitolo esamina il quadro normativo costituzionale e sovranazionale in cui si colloca il diritto alla libertà religiosa. Il secondo capitolo si concentra sull'impatto che tale diritto assume all'interno dei rapporti familiari, mettendo in luce le problematiche emergenti nei casi di separazione, affidamento dei minori e conflitti educativi. Il terzo capitolo analizza le principali pronunce della Cassazione nei casi in cui la libertà religiosa entra in tensione con altri diritti e con il diritto penale, affrontando questioni legate alla libertà di espressione, la discriminazione, il vilipendio del sentimento religioso ed ai limiti delle pratiche religiose in rapporto a condotte illecite. Attraverso l’esame della giurisprudenza, questo studio si propone di evidenziare come il diritto alla libertà religiosa sia tutelato e, al tempo stesso, disciplinato nei suoi limiti, in un costante tentativo di bilanciare i valori costituzionali diversi ma egualmente rilevanti in uno Stato democratico e pluralista.
