The following paper explores the safeguards that guarantee journalistic activity from an international perspective and, in particular, from the perspective of the Court of Strasbourg. The focus is primarily on the historical heritage of journalism, where it was born, how it developed and how it has tried to defend itself during world conflicts and the period of totalitarianism, with a look to the Italian case and in comparison with the rest of the world. Subsequently, the topics are treated from the human point of view, in particular on how the international thought developed and on the identification of conventional freedoms, which are necessary for the maintenance of democracy and society. The concepts of freedom of expression and information will often be mentioned during the course of the report, especially with regard to the rights, duties, responsibilities and safeguards that characterize journalistic activity. In addition, the paper reflects on the meaning of margin of appreciation, of watchdog of democracy and, also, the deep connection between freedom of expression and hate speech, considering the addition of restrictions for the maintenance of the order of society. Finally, the last chapter of the paper will reflect on the development of the journalistic profession and the future of journalists, who have been catapulted, in the past few decades, in a world characterized by technology and innovation. Topics such as the use of social media, fake news, the creation of new professional positions supporting journalists and the way of thinking of the Court will be explored, in addition to thoughts and opinions of the author on a subject as fascinating as complex, as that of journalism today.
Nel seguente elaborato vengono esplorate le tutele a garanzia dell’attività giornalistica secondo una prospettiva internazionale e, in particolare, nell’ottica della Corte di Strasburgo. L’attenzione viene riposta, in primo luogo, sulle discendenze storiche del giornalismo, dove nasce, come si sviluppa e come ha cercato di difendersi durante i conflitti mondiali e il periodo dei totalitarismi, con uno sguardo sempre attento al caso italiano e al confronto con il resto del mondo. Successivamente, vengono trattati gli argomenti dal punto di vista umano, in particolare su come si delinea il pensiero internazionale e sull’individuazione di libertà convenzionali, necessarie al mantenimento della democrazia e della società. I concetti di libertà di espressione e di informazione verranno citati spesso lungo il corso dell’elaborato, soprattutto in riferimento ai diritti, ai doveri, alle responsabilità e alla salvaguardia che caratterizzano l’attività giornalistica. Inoltre, sarà approfondito il significato di margine di apprezzamento, di watchdog della democrazia e la profonda connessione tra libertà di espressione e incitamento all’odio osservando, dove è opportuno, l’inserimento di restrizioni per il mantenimento dell’ordine della società. Infine, nell’ultimo capitolo dell’elaborato si rifletterà sullo sviluppo della professione giornalistica e sul futuro degli esercenti della professione, i quali sono stati catapultati, negli ultimi decenni, in un mondo caratterizzato dalla tecnologia e dall’innovazione. Si approfondiranno tematiche come l’utilizzo dei social media, la problematica delle fake news, la creazione di nuove posizioni professionali a supporto dei giornalisti e la linea di pensiero della Corte, il tutto scandito da pensieri ed opinioni dell’autore in merito ad un argomento tanto affascinante, quanto complesso, come quello del giornalismo odierno.
