This study aims to explore in detail the historical framework, legal implications and perspectives of the new agile work models and telecommuting. The analysis focuses on the development of these work arrangements, their definition, and the resulting regulatory considerations. Special attention is given to their evolution in the context of the post-Covid-19 era. The first chapter provides an overview of the historical paths that led to the emergence of agile work and telecommuting. The terms involved are defined and contrasts with traditional work models are highlighted. In this context, the cultural and technological roots that contributed to the spread of these new ways of working are explored. In the second chapter, an analysis is made of the legal framework governing agile work and teleworking. Existing laws are examined, recent updates are identified, and additional insights are provided from the current legislative context. The challenges and opportunities emerging from these regulations are explored and critical reflections on their practical application are offered. The third chapter broadens the perspective by examining how different agile work arrangements have developed in Europe and other parts of the world. Relevant legislation at the European and non-European levels is explored, analyzing differences and similarities. In particular, the lack of adequate protection for agile workers and teleworkers in Italy is investigated, comparing this situation with that in other countries. The fourth chapter presents the results of an empirical investigation conducted to assess the advantages and disadvantages of new work modes, especially after the Covid-19 pandemic. The research method is described, the purposive sample is explained, and initial considerations of the data collected are offered. The conclusions present the full results of the empirical investigation and discuss the implications of these results for the future of agile work and telecommuting.
Questo studio si propone di esplorare in dettaglio il quadro storico, le implicazioni legali e le prospettive dei nuovi modelli di lavoro agili e del telelavoro. L’analisi si concentra sullo sviluppo di queste modalità lavorative, sulla loro definizione e sulle considerazioni normative che ne derivano. Un’attenzione particolare è riservata alla loro evoluzione nel contesto dell’era post-Covid-19. Il primo capitolo offre una panoramica dei percorsi storici che hanno portato alla nascita del lavoro agile e del telelavoro. Vengono definiti i termini coinvolti e vengono messi in evidenza i contrasti con i modelli di lavoro tradizionali. In questo contesto, si esplorano le radici culturali e tecnologiche che hanno contribuito alla diffusione di queste nuove modalità di lavoro. Nel secondo capitolo, si procede a un’analisi del quadro normativo che regola il lavoro agile e il telelavoro. Si esaminano le leggi esistenti, si identificano gli aggiornamenti recenti e si forniscono ulteriori spunti a partire dal contesto legislativo attuale. Vengono esplorate le sfide e le opportunità che emergono da queste normative e si offrono riflessioni critiche sulla loro applicazione pratica. Il terzo capitolo amplia la prospettiva, esaminando come diverse modalità di lavoro agili si siano sviluppate in Europa e in altre parti del mondo. Si esplora la normativa di riferimento a livello europeo ed extraeuropeo, analizzando le differenze e le somiglianze. In particolare, si indaga sulla mancanza di tutela adeguata per i lavoratori agili e i telelavoratori in Italia, confrontando questa situazione con quella di altri Paesi. Il quarto capitolo presenta i risultati di un’indagine empirica condotta per valutare i vantaggi e gli svantaggi delle nuove modalità di lavoro, specialmente dopo la pandemia da Covid-19. Si descrive il metodo di ricerca, si spiega il campione di riferimento e si offrono prime considerazioni sui dati raccolti. Nelle conclusioni vengono presentati i risultati completi dell’indagine empirica e si discutono le implicazioni di tali risultati per il futuro del lavoro agile e del telelavoro.
