L'accesso alle prestazioni sanitarie: il problema delle liste d'attesa

This dissertation analyzes access to healthcare services within the National Health Service, with particular reference to the problem of waiting lists. Through an examination of current legislation, case law, and scholarly contributions, the work explores the relationship between the right to healthcare and the effectiveness of healthcare services. Particular attention is paid to the critical issues within the system and the protection mechanisms available to citizens. The analysis highlights how waiting lists represent a significant obstacle to the full realization of the right to healthcare, requiring organizational and regulatory interventions to ensure their effectiveness.

La tesi analizza il tema dell’accesso alle prestazioni sanitarie nel Servizio Sanitario Nazionale, con particolare riferimento al problema delle liste d’attesa. Attraverso l’esame della normativa vigente, della giurisprudenza e dei contributi dottrinali, il lavoro approfondisce il rapporto tra diritto alla salute ed effettività delle prestazioni. Particolare attenzione è dedicata alle criticità del sistema e agli strumenti di tutela previsti per i cittadini. L’analisi evidenzia come le liste d’attesa rappresentino un limite significativo alla piena realizzazione del diritto alla salute, richiedendo interventi organizzativi e normativi volti a garantirne l’effettività.
