Holocaust denial was born in the first years after world war II. it is divided in 3 phases: ideological, technique and trough internet. From the 1970s onwards there was a growing number of these ideas, and consequently the various States were questioned about a possible offense of denialism. Can democracy protect itself against ideas that deny its foundations? or should she opt for a free markerplace of ideas? the thesis will try to answer this question first, on the basis of italian constitutional principles, and then on the basis of the judgments of the Court EDU. Finally, the thesis will analyze the aggravating of Holocaust denial introduced by the italian lawmaker with the law number 115/2016.

Il negazionismo nasce nei primi anni del secondo dopo guerra. Esso si suddivide in 3 fasi: ideologica, tecnica e via internet. Dagli anni '70 in poi c'è stato un crescendo di queste idee, di conseguenza i vari Stati si sono interrogati su un eventuale intervento penale. Può la democrazia proteggersi contro quelle idee che negano le proprie fondamenta? oppure deve optare per un free marketplace of ideas?la tesi cercherà di rispondere a questa domanda prima, in base ai principi costituzionali italiani, poi sulla base delle sentenze della Corte EDU. Infine si analizzerà l'aggravante di negazionismo introdotta dal legislatore italiano con la legge numero 115/2016.
