Diritto di asilo e politiche migratorie

The present study aims to provide an in-depth analysis of the institute of asylum, in the Italian, EU and international order. In order to do so, it was chosen to start from the historical evolution of asylum in Italy, from the post-war period to the present day, to then move on to an in-depth analysis of the art. 10, paragraph 3 of the italian Constitution. In the second chapter the gaze was - at first - turned to the discipline of the institute in the international sphere (with particular regard to the Geneva Convention), to then move to the communitarian legislation. In the third and last chapter, the most recent Italian discipline of asylum was examined: the so-called "decreto sicurezza" and the "decreto sicurezza bis", both converted into law.

Il presente elaborato si propone di fornire una approfondita analisi dell'istituto dell'asilo, nell'ordinamento italiano, comunitario e internazionale. Per far ciò, si è scelto di partire dall'evoluzione storica dell'asilo in Italia, dal dopoguerra ai giorni nostri, per passare poi ad un'analisi approfondita dell'art. 10, comma 3 Cost. Nel secondo capitolo si è volto lo sguardo alla disciplina dell'istituto in ambito internazionale (con particolare riguardo alla Convenzione di Ginevra), per poi passare alla normativa comunitaria. Nel terzo e ultimo capitolo, si è infine esaminata la più recente disciplina italiana dell'asilo: il cd. "decreto sicurezza" e il "decreto sicurezza bis", entrambi convertiti in legge.
