The work is mainly concerned with analyzing how the health emergency from Covid-19 has affected the fundamental freedoms provided for in the Constitution. The first chapter refers to the inviolable rights of man and the fundamental freedoms provided for in situations of "normality". Furthermore, the principle of decentralization envisaged by article 5 of the Constitution was analyzed, as well as the relationship between the State and the Regions, in relation to which I specifically focused on the ways in which health relations are managed. . Subsequently I analyzed how the emergency was managed at a regulatory level, with specific reference to the acts issued in recent months by the Government. On the basis of the contributions provided by the doctrine, doubts of the proportionality of the measures adopted by the Government in the management of the pandemic were addressed. I also stressed that the emergency was characterized by a constant presence of the Government to the detriment of a Parliament almost absent in its legislative function. Some of the freedoms involved in the restrictive measures implemented in the management of the emergency were analyzed, of which I focused mainly on the limitations that occurred in the area of freedom of movement and the right to education. The last chapter of the work deals with dealing with the relations between the State and the Regions in the management of the emergency, underlining how, sometimes, the Regions have abused their powers of ordinance, issuing acts that go beyond their own competences, always on the basis of how much doctrine I have offered in my contributions.
Il lavoro si occupa principalmente di analizzare come l'emergenza sanitaria da Covid-19 abbia colpito le libertà fondamentali previste in Costituzione. Il primo capitolo fa riferimento ai diritti inviolabili dell'uomo e alle libertà fondamentali previste in situazioni di "normalità". E' stato, inoltre, analizzato il principio di decentramento previsto dall'articolo 5 della Costituzione, ed il rapporto che intercorre tra Stato e Regioni, in relazione al quale mi sono soffermata nello specifico sulle modalità con le quali vengono gestiti i rapporti in materia sanitaria. Successivamente ho analizzato come l'emergenza sia stata gestita a livello normativo, con specifico riferimento agli atti emanati in questi mesi dal Governo. Sulla base dei contributi forniti dalla dottrina, sono stati affrontati i dubbi di proporzionalità delle misure adottate dal Governo nella gestione della pandemia. Ho, inoltre, sottolineato come l'emergenza sia stata caratterizzata da una presenza costante del Governo a discapito di un Parlamento quasi assente nella sua funzione legislativa. Sono state analizzate alcune delle libertà coinvolte dalle misure restrittive messe in atto nella gestione dell'emergenza, delle quali mi sono soffermata principalmente sulle limitazioni intervenute nell'ambito della libertà di circolazione e del diritto all'istruzione. L'ultimo capitolo del lavoro si occupa di trattare i rapporti tra Stato e Regioni nella gestione dell'emergenza, sottolineando come, talvolta, le Regioni abbiano abusato dei loro poteri di ordinanza, emanando atti che andassero oltre le proprie competenze, sempre sulla base di quanto la dottrina ho offerto nei propri contributi.
