Il Whistleblowing come meccanismo di compliance

The objective of the paper is to present a relatively new theme for our legal system: Whistleblowing. This term indicates the procedures implemented by the employee who, within a public or private entity, has conducted illegal signals. The analysis involves various Italian laws, provisions and decrees, as well as foreign laws aimed at protecting the whistleblower, arriving, in conclusion, at the presentation of a practical case.

L'obiettivo dell'elaborato è quello di presentare una tematica relativamente nuova per il nostro ordinamento: il Whistleblowing. Con tale termine si indicano le procedure messe in atto dal dipendente che, all'interno di un ente pubblico o privato, segnali condotte illecite. L'analisi coinvolge diverse leggi, provvedimenti e decreti italiani, nonché esteri volti alla tutela del whistleblower, arrivando, in conclusione, alla presentazione di un caso pratico.
