THE GOVERNANCE OF HEALTH DATA IN THE EUROPEAN UNION: LEGAL FRAGMENTATION, RESEARCH BARRIERS, AND THE FUTURE OF THE EHDS

The thesis investigates the impact of European regulations on health data on medical research. Following the introduction, key concepts are explained to ensure a clear understanding of the regulations (in particular the GDPR and EHDS). It then goes on to study the current state of the art by comparing the legal systems of five different EU countries with the aim of determining whether there is fragmentation in the implementation of the GDPR, and then establishing the impact of this fragmentation on medical research. The final chapter analyses the EHDS to understand how it will affect the current system.

La tesi analizza l'impatto delle normative europee sui dati sanitari nella ricerca medica. Dopo l'introduzione, vengono spiegati i concetti chiave per garantire una chiara comprensione delle normative (in particolare il GDPR e l'EHDS). Si passa quindi allo studio dello stato dell'arte attuale, confrontando i sistemi giuridici di cinque diversi paesi dell'UE con l'obiettivo di determinare se vi sia frammentazione nell'attuazione del GDPR e quindi stabilire l'impatto di tale frammentazione sulla ricerca medica. Il capitolo finale analizza l'EHDS per comprendere come influirà sul sistema attuale.
