DALLA TECNOLOGIA BLOCKCHAIN AI NON FUNGIBLE TOKEN: I NUOVI CASI DI UTILIZZO E GLI INTERROGATIVI LEGALI

The purpose of this brief summary is to outline the guidelines of the dissertation, in order to make clear the common thread and the logical path that will be followed. Therefore, the report will begin by analyzing the radical change of what everyone knows as "Web", arriving, in recent years, to the so-called Web 3.0 or Metaverso; this change is due to the rapid development of new technologies (blockchain, cryptocurrency, NFT, virtual reality, augmented and artificial intelligence), allowing users to interact and socialize with each other in a more engaging way, create content, participate in discussions, work virtually and be part of a real community. Moreover, thanks to the concepts of decentralization and disintermediation of Web 3.0, users can be considered as the only owners with decision-making power over their personal data and the information introduced on the Web. Subsequently, with a careful focus on one of the most disruptive technologies of the last period: the NFTs, I have studied in depth the first commercial cases, the hype that has been created around this phenomenon and the consequent speculative bubble, the latest market applications and how this tool is changing countless aspects of everyday life and business, thanks to a greater awareness of what this technology together with blockchain can offer. In particular, there are: the creation of innovative marketing strategies, awareness and engagement, the creation and membership of specific communities, a new vision of identity, the digital introduction of the concepts of ownership and scarcity, new investment, collecting and entertainment possibilities. Finally, I will analyze the challenges and legal questions arising from the use of NFT and blockchain, with particular interest for the rights of the data subject, copyright and the illicit use works of art or distinctive signs of third parties.

L’obiettivo di questo breve riassunto è delineare le linee guida dell’elaborato. La tesi analizza anzitutto la modifica radicale di quello che tutti conoscono come “Web”, arrivando, proprio negli ultimi anni, al cosiddetto Web 3.0 o Metaverso; tale cambiamento è dovuto al celere sviluppo di nuove tecnologie (blockchain, criptovalute, NFT, realtà virtuale, realtà aumentata e intelligenza artificiale) e questo ha permesso agli utenti di poter interagire e socializzare in maniera più coinvolgente ed interattiva, creare contenuti, partecipare a discussioni, lavorare virtualmente e far parte di una vera e propria community. Inoltre, grazie ai concetti di decentralizzazione e disintermediazione propri del Web 3.0, gli utenti possono essere considerati come gli unici proprietari con potere decisionale sui propri dati personali e sulle informazioni introdotte nel Web, rivoluzionando anche il concetto di fiducia. Successivamente, la tesi analizza una delle tecnologie più dirompenti dell’ultimo periodo: gli NFT. Rispetto ad essi si sono studiati approfonditamente i primi casi commerciali, l’hype che si è creato attorno a questo fenomeno con la conseguente bolla speculativa, le applicazioni di mercato più recenti e come tale strumento stia cambiando molti aspetti della vita quotidiana e del business, proprio grazie ad una maggiore presa di coscienza di quanto questa tecnologia assieme alla blockchain può offrire. In particolare, si annoverano: la messa appunto di innovative strategie di marketing, di awareness ed engagement, la creazione e l’appartenenza a specifiche community, una nuova visione di identità, l’introduzione nel digitale dei concetti di proprietà e di scarsità, nuove possibilità di investimento, di collezionismo e di intrattenimento. Infine, si analizzano le sfide e i quesiti legali che scaturiscono dall’uso degli NFT e della blockchain, con particolare interesse per i diritti dell’interessato, il trattamento dei dati, il diritto d’autore, il copyright e gli usi illeciti di opere o segni distintivi di terzi.
