This thesis examines the persistent gap between technological innovation and legal regulation, arguing that the gap is not merely structural but primarily cognitive. The analysis addresses two central actors. Entrepreneurs, whose optimistic bias accelerates technological development and diffusion beyond society's capacity to assess the associated risks. Legislators, whose cognitive limitations — recency bias, the illusion of understanding, status quo bias, and anchoring to inherited analogies — produce regulation that is reactive, incoherent, and misaligned with the realities of innovation. The original contribution is the Cognitive Gap Model, which integrates these two dimensions and identifies the mechanism of their interaction: the feedback relationship that would keep innovation and governance aligned is disabled at both ends, since the risk signal is suppressed on the entrepreneurial side before it can be transmitted and misperceived on the regulatory side when it is received. The resulting gap is multiplicative rather than additive, and tends to widen rather than stabilise. From this diagnosis follows a constructive conclusion: if the gap is cognitive in origin, it is at least partly addressable — not by urging actors to think better, but by designing institutions that compensate for the cognitive limitations of those who staff them.

Abstract
From this diagnosis follows a constructive conclusion: if the gap is cognitive in origin, it is at least partly addressable — not by urging actors to think better, but by designing institutions that compensate for the cognitive limitations of those who staff them.| File | Dimensione | Formato | |
